Sample Arbitration Clauses

1. Any dispute, controversy or claims arising out of or relating to this contract or the breach or termination thereof shall be settled by a single arbitrator under the Rules of the British Columbia Arbitration and Mediation Institute; the hearing shall be held in British Columbia.
   
2. Any dispute, controversy or claims arising out of or relating to this contract or the breach or termination thereof shall be settled by arbitration under the Rules of the British Columbia Arbitration and Mediation Institute with three arbitrators. Each party shall appoint one arbitrator. The third arbitrator shall be appointed by the British Columbia Arbitration and Mediation Institute. The hearing shall be held in British Columbia.
   
3. All disputes arising out of or in connection with this contract, or in respect of any defined legal relationship associated herewith or derived therefrom, shall be referred to and finally resolved by arbitration in accordance with the arbitration rules of the British Columbia Arbitration and Mediation Institute. The appointing authority shall be the British Columbia Arbitration and Mediation Institute. The case shall be administrered by the British Columbia Arbitration and Mediation Institute in accordance with its arbitration rules. The place of arbitration shall be Vancouver, or, if agreed to between the parties, any other location in the province of British Columbia.

Sample Mediation Clause

1. If a dispute arises out of or relates to this contract, or the breach thereof, and the dispute cannot be settled by negotiations between the parties, the parties agree first to try in good faith to settle the dispute by mediation administered by the British Columbia Arbitration and Mediation Institute under its mediation rules before resorting to arbitration, litigation, or some other dispute resolution procedure.
